The 1998 Data Protection Act covers both electronic and manually held records.
The aim of the legislation is to prevent people or organisations from holding and using inaccurate information on individuals, and also to give the public confidence that their personal information is being used correctly.
Breaches of Data Protection legislation are criminal offences and can result in severe penalties.
The Act is further supplemented with The Privacy and Electronic Communications Regulations 2003 which provide explicit guidance for electronic marketing.
Some situations and cases are exempt from the Act, but these should be reviewed on an individual basis.
